Bei den ersten Don Juan Days am 5. und 6. November 2010 stellte eine internationale Gruppe von Wissenschaftlerinnen und Wissenschaftlern unterschiedlicher Disziplinen aktuelle Forschungsergebnisse zum Thema „Viva la libertà“ – The Dissoluto punito’s Genesis and First Stagings (1787-1788) zur Diskussion. Der Charakter dieser Veranstaltung im kleinen Kreis, der durch Impulsreferate und ausführliche Diskussionen über die einzelnen Beiträge gekennzeichnet war, wird auch bei den Don Juan Days 2012 beibehalten. Zwei der diskutierten Themen sollen nunmehr vertieft und verbunden werden: die „Wiener Tradition“ des Don Juan und ihre rechtlichen Rahmenbedingungen.

Don Juan wurde im Laufe seiner literarisch-exegetischen Rezeption oft als gesetzlos oder als Anarchist bezeichnet, und dennoch ist seine (Bühnen-)Geschichte in nicht geringem Maß durch die rechtlichen Rahmenbedingungen der Theaterproduktion und -rezeption, also Maßnahmen des Staates bzw. der jeweiligen Gebietskörperschaft, geprägt. Damit sind allgemeine Gesetze – etwa zum Reiseverkehr, die für jede reisende Theatergesellschaft, besonders aber für die international agierenden Opernensembles von Bedeutung waren, oder zur Bauordnung, durch welche die szenischen Möglichkeiten einer Aufführung begrenzt wurden – ebenso gemeint, wie Vorschriften zur Regelung des Theaterwesens selbst. Letztere können sowohl fördernden wie verhindernden Charakter haben, wobei das Beispiel der Zensur zeigt, dass eine repressiv intendierte Institution sehr wohl kreative Prozesse auslösen kann – auch aufseiten des Zensors.

Im Mittelpunkt der Don Juan Days 2012 steht daher die Frage nach der Bedeutung der rechtlichen Rahmenbedingungen für die Wiener Tradition von Don-Juan-Stücken, die auf das Jahr 1660 zurückgeht und seit 1753 in dokumentarischer Kontinuität nachgewiesen ist.
